General Education
Santa Clara Unified adheres to California Ed Code 49076 which protects the privacy of student records. It states schools cannot share a student’s personal information without written permission from the student’s parent or the student if they are 18 or older. There are some exceptions to this rule, allowing schools to share information in specific situations.
Per BP 5125, requested records will be provided within five business days, unless otherwise indicated.
Special Education
Santa Clara Unified adheres to California Ed Code 56043(n) and 56504, which requires a Local Educational Agency (LEA) to provide parent(s), an approved third party, or a new LEA with copies of student records within 5 business days and before any IEP meeting or resolution session.
Permissible exemption from disclosure include parent(s) requesting documents for a student who is 18 years of age or older or third parties without a signed release of information (ROI). If the student is 18 years of age or older, parent(s) can request student records if the parent(s) provide a copy of a court-ordered conservatorship document.
