Notice Regarding Developer Fees: Effective June 10, 2024
Santa Clara Unified School District - Residential and Commercial/Industrial Development School Fee Justification Study
The Board of Trustees approved an increase to the fees on April 11, 2024, which will begin on June 10, 2024.
Fees as of June 10, 2024:
Residential:
- Single Family Detached: $5.17 per square foot
- Multifamily Attached: $5.17 per square foot
- Senior Housing: $0.84 per square foot
Commercial:
- Retail and Services: $0.80 per square foot
- Office: $0.84 per square foot
- Research and Development: $0.84 per square foot
- Industrial/Warehouse/Manufacturing: $0.84 per square foot
- Hospital: $0.84 per square foot
- Hotel/Motel: $0.40 per square foot
- Self-Storage: $0.02 per square foot
These are the minimum fees required to be paid by property owners and are set by the State Allocation Board (SAB), which oversees the Office of Public School Construction (OPSC).
No impact fees are due on Additional Dwelling Units (ADU's) or additions to existing residential units under 500 square feet. The Building Department will fill out the SCUSD form, which calculates the required fees.

Payment Options
Developer fee payments can be made by in-person appointment or by mail.
In-Person Payment (By Appointment Only)
Our office accepts in-person payments by appointment only from Monday through Friday, 9 AM to 4 PM. To schedule an appointment, please email fdp@scusd.net with your preferred date and time, and we will confirm availability.

- Certification of Compliance form (issued by the city, partially filled out, detailing the amount due)
- Accepted Payment Methods:

- A check made out to Santa Clara Unified School District (SCUSD)
- Your Certification of Compliance form (issued by the city, partially filled out, detailing the amount due)

The actual impact cost of residential construction on school facilities is:
- Single Family Detached: $6.25 per square foot, based on a 2,518 square foot average.
- Multi-family Attached: $14.24 per square foot based on a 928 square foot average.
This is a residential monetary shortfall of $1.08 (single-family detached) and $9.07 (multi-family attached) per square foot developed.
The actual impact cost of commercial construction to school facilities per square foot constructed is:
- Retail and Services: $2.23
- Office: $3.49
- Research and Development: $3.03
- Industrial/Warehouse/Manufacturing: $2.69
- Hospital: $2.77
- Hotel/Motel: $1.13
- Self Storage: $0.06
The State Statutory fee for commercial construction is $0.84 per square foot.
Due to the monetary shortfall, the District requests developers to include a Voluntary Community Benefit amount to fully mitigate the actual impact of the development. Please contact the FDP Department for more information or refer to the Developer Fee Justification Studies.
Notice to Applicants Paying Developer Fees
As an applicant paying developer fees, please be aware of the following rights:

Right to Request an Audit
Under Government Code Section 66023, you have the right to request an audit of the fee program. This request must be made in writing and submitted to the governing board. -
Right to Request Meeting Notification
You have the right to request notice of the governing board meeting at which the annual report on the developer fee program will be reviewed.
